Applying for remedial classes (private education and training institutions) requires a series of administrative approval procedures in mainland China, which mainly involve education, market supervision, fire protection, public security and other departments. The following are the core steps and precautions. Please be sure to refer to the latest local policies: 1. List of core procedures 1. School license (the most critical) · Approval authority: the local education administrative department (Education Bureau) at or above the county level. · Requirements: · Have an organizational structure and articles of association that meet the regulations. · There are qualified teachers (need to hold the corresponding teacher qualification certificate). · Have stable funding sources and standard teaching venues. · Teaching venues must pass fire inspection and acceptance (fire protection registration/safety inspection is required for areas below 300 square meters). · Subject-based training must comply with the "double reduction" policy requirements (not allowed during holidays, winter and summer vacations). 2. Business license or private non-enterprise unit registration · For-profit institutions: Go to the market supervision department to apply for a "Business License". The business scope must include "education and training" or "after-school tutoring". · Non-profit organizations: Go to the civil affairs department to apply for the "Private Non-Enterprise Unit Registration Certificate". · Note: You must first obtain the "School Operating Permit" before you can apply for a business license. 3. Fire and Safety Acceptance · The teaching venue must pass the fire department inspection and obtain the "Fire Safety Inspection Certificate" or registration certificate. · Emergency lights, fire extinguishers, safety exit signs and other facilities must be equipped. · Provide a house safety appraisal report (required in some areas). 4. Housing and environmental protection requirements · Provide site property ownership certificate or lease contract (the lease period is generally required to be more than 3 years). ·Residential residences, basements, industrial plants, etc. Usually cannot be used as school venues. · Some areas require environmental impact assessment filing (especially those involving chemical experiments and other courses). 5. Qualifications of teachers and administrators · Teachers must hold teacher qualification certificates for the corresponding disciplines and school stages. · The legal representative and principal must have teaching qualifications and have no criminal record. 6. Charge supervision and contract filing · It is necessary to sign a fund supervision agreement with the bank to ensure the safety of prepaid funds. · Use the "Off-campus Training Service Contract for Primary and Secondary School Students (Model Text)" formulated by the Ministry of Education and the State Administration for Market Regulation. · The charging standards must be publicly announced, and fees for more than 3 months or 60 class hours are not allowed at one time. 2. Overview of the application process 1. Name verification and preparation: Submit an application for institution name approval to the Education Bureau, and prepare materials such as venue and teachers. 2. Submit application materials: Submit application materials for "School Operating License" to the Education Bureau (including school charter, site certificate, teacher certification, fire protection acceptance documents, etc.). 3. On-site review: The Education Bureau cooperates with fire protection, housing and construction and other departments to conduct on-site review. 4. Receive the School License: After passing the review, receive the "School License". 5. Apply for a business license: Go to the market supervision or civil affairs department to register as a legal person with your school license. 6. Follow-up filing: engraving official seal, opening bank account, handling tax registration, reporting and charging supervision, etc. 3. Special precautions · "Double reduction" policy restrictions: If you carry out training in Chinese, mathematics, English and other subjects, you must strictly follow national regulations (it is prohibited to use vacation training, you need to register as a non-profit, and the fees are subject to guide prices, etc.). Non-disciplinary training such as art, sports, and science and technology is managed by local culture, sports, and science and technology departments, and corresponding licenses are required. · Site safety standards: The teaching floor is generally no higher than 3 floors (primary school student training is no higher than 2 floors), and the building area per student is no less than 3 square meters. · Online education: If you want to carry out online training, you need to apply for registration with the provincial education department and pass the information security level protection assessment. 4. Recommended steps 1. Consult the local education bureau: learn more about the specific policies of the region (implementation details vary greatly from place to place). 2. Rent compliant venues: ensure that fire protection, structure, and environmental protection standards are met. 3. Reserve teaching staff: Recruit certified teachers and form a management team. 4. Entrust a professional agency: If the procedures are complicated, you may consider consulting a professional agency for assistance. 5. Complete legal person registration: After obtaining the school license, apply for a business license as soon as possible. Reminder of common misunderstandings · The "Education Consulting Company" business license cannot be used in place of the school license to conduct training. · Fire protection acceptance must be handled in advance and cannot be done later. ·Teacher qualifications need to be publicized, and part-time teachers must also meet regulations. Finally, since the policy may be adjusted, please be sure to verify the latest policies with the local education bureau, market supervision bureau, and fire brigade before handling to ensure compliance operations.
